Terms of Service

These terms govern access to and use of TrustBoost’s review collection and processing service.

1. About these terms

TrustBoost is operated by CYBERGROUP GLOBAL LTD, of 4th Floor Silverstream House, Fitzroy Street, London, England, W1T 6EB. By creating an account, signing an order or using the service, you agree to these terms. If you act for an organisation, you confirm that you have authority to bind it.

2. The service

TrustBoost provides tools for businesses to collect and process customer reviews. Features may change as the service develops. Any order form or written service agreement forms part of these terms and takes priority if there is a conflict.

3. Accounts and security

You must provide accurate information, protect account credentials and promptly notify us of suspected unauthorised use. You are responsible for activity under your account and for ensuring that authorised users follow these terms.

4. Your responsibilities

You must have a lawful basis and all necessary notices or permissions to provide personal information to TrustBoost and to contact customers. You must configure and use review and marketing communications in accordance with data protection, privacy, consumer protection and marketing laws.

You must not:

  • submit false, misleading or unlawfully obtained information;
  • fabricate, buy, suppress or improperly influence reviews;
  • use TrustBoost for spam, harassment, discrimination or unlawful marketing;
  • upload malicious code, attempt unauthorised access or interfere with the service;
  • copy, reverse engineer or resell the service except where expressly permitted.

5. Reviews and customer content

You and your customers retain ownership of content submitted through the service. You grant us a non-exclusive licence to host, process, reproduce and display that content only as needed to provide, secure and improve the service and meet legal obligations.

You are responsible for the legality, accuracy and fairness of your review collection practices. We may remove or restrict content that appears unlawful, fraudulent, abusive or inconsistent with these terms.

6. Privacy and data protection

Our Privacy Policy explains how we handle personal information. Where we process personal data on your documented instructions, each party will comply with applicable data protection law and any agreed data processing terms.

7. Fees

Fees, billing periods and plan limits are set out when you order the service. Unless stated otherwise, fees exclude applicable taxes and are non-refundable except where required by law. We will give reasonable notice of material pricing changes affecting a continuing subscription.

8. Availability and third-party services

We aim to provide a reliable service but do not promise uninterrupted or error-free operation. TrustBoost may depend on third-party hosting, communications, authentication or integration services that we do not control.

9. Intellectual property

TrustBoost and its licensors own the service, software, branding and related intellectual property. These terms give you a limited, non-exclusive, non-transferable right to use the service during your subscription; they do not transfer ownership.

10. Suspension and termination

You may stop using TrustBoost at any time, subject to any agreed subscription commitment. We may suspend or terminate access for material breach, non-payment, security risk, unlawful use or where necessary to protect users or the service. Where practical, we will give notice and an opportunity to remedy the issue.

11. Liability

Nothing in these terms excludes liability that cannot legally be excluded, including liability for fraud or fraudulent misrepresentation, or death or personal injury caused by negligence.

Subject to that, neither party is liable for indirect or consequential loss, loss of profits, revenue, goodwill or anticipated savings. Our total aggregate liability arising from the service will not exceed the fees paid or payable for the service in the 12 months before the event giving rise to the claim. This section does not affect rights that cannot be limited by law.

12. General

We may update these terms for legal, security or service reasons and will give reasonable notice of material changes. You may not transfer your rights without our consent; we may transfer ours as part of a reorganisation or sale. If a provision is unenforceable, the remainder continues in effect. Delay in enforcing a right is not a waiver.

13. Governing law and contact

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, unless applicable law requires otherwise.
